Klemchuk Kubasta Partner Darin Klemchuk Presents CLE Course on Trademark Law

June 11, 2012 — Darin M. Klemchuk, senior partner at Klemchuk Kubasta LLP (KK LLP), a leading full-service intellectual property (IP) law firm, will be presenting, “Secondary Liability for Trademark Infringement and the Online Space” at this year’s State Bar of Texas Annual Meeting held in Houston, Texas on June 14-15, 2012. His presentation is part of the two-day continuing legal education (CLE) program on Litigation, Legal Innovations 2012, Business and Corporate Counsel, Law Practice Management, Intellectual Property and Criminal Law. Klemchuk’s presentation will cover the background and early development of secondary liability, with a focus on contributory trademark infringements, such as in the case of Inwood Laboratories Inc. v. Ives Laboratories, Inc. His presentation will also discuss specific applications of secondary liability covering topics on: domain name registrars, Internet websites, Internet service providers (ISP), the online marketplace, search engine companies and affiliate marketing. Klemchuk’s presentation concludes with the damages and remedies inherent with secondary infringement.

“This presentation will explore the basic background of secondary liability as well as the recent development where courts have stretched the old precedents to fit new context present in the online arena,” he said. “The Internet is a very difficult-to-police marketplace with its vastly growing context and the increasing technology development. That’s why secondary liability in the trademark context continues to be an interesting area of law as it develops.”
