Supplemental Register

Term: Supplemental Register

Definition: A secondary register maintained by the United States Patent and Trademark Office (USPTO) for trademarks that do not meet the requirements for registration on the Principal Register.  The Supplemental Register is reserved for trademarks that are capable of distinguishing goods or services and are in use in commerce, but do not meet the requirements to be included in the Principal Register.  After five years of use and inclusion in the Supplemental Register, trademark owners can refile for inclusion in the Supplemental Register.
