Term: Intent to Use (ITU) Basis

Definition: Legal basis that can be used to file a trademark application if the applicant has not started using the trademark in commerce, but has a bona fide intention to do so. An ITU trademark application cannot actually be registered until the applicant can demonstrate using it in commerce and file the proper TEAS form. This filing basis is also called Section 1(b).
