The Office with scrutinize your application in a process called trademark examination that will result in either a successful registration or an office action requiring attention. The process can take months and often involves a back and forth between the USPTO and the applicant.

Attorney Requirements

The USPTO requires foreign-domiciled individuals to have an attorney who is licensed to practice law in the United States when filing a trademark application. If you live in the United States, you are not required to have an attorney. It is, however, inadvisable to proceed without one as the process can be complicated and requires some specialized knowledge. Even the USPTO “strongly encourages” individuals to hire a licensed trademark attorney.

One such benefit is getting ahead of potential issues that may result in an office action, like determining if the mark is distinctive or descriptive, if you have satisfied the requisite use-in-commerce requirements, or if you have selected appropriate specimens to demonstrate this use. Should the USPTO issue an office action, properly responding to potential substantive issues can be a complicated matter that may require the expertise of a licensed attorney. Further, should your application get rejected and require an appeal to the Trademark Trial and Appeal Board (TTAB), having an attorney already familiar with the details of the application can save time and hassle in bringing the appeal.
