Texas Now Regulates Soliciting of Sales by Text – 1 Hr CLE Credit

As of September 1, 2025, Texas Senate Bill 140 came into force, extending regulation of telephone solicitation to SMS text messaging. Learn about the requirement to register with the Texas Secretary of State, First Amendment challenges to the obligation to register, exemptions from registration, the burden of proof in claiming exemptions, ongoing post-registration reporting obligations, civil and criminal penalties for non-compliance, application of the DTPA to statutory violations, and best practices and precautions businesses should adopt before soliciting sales by text in or into Texas.

Anthony “Tony” Magee is a commercial litigator and intellectual property litigator and counselor. For four decades, Tony has helped individuals and businesses protect, enforce, and defend their commercial interests and property assets, including real estate and intellectual property assets. Tony practiced initially as a Chancery Barrister in the U.K., handling all types of property disputes, including real estate and probate matters, and then as a Dallas-based attorney.
Before forming Magee Legal, PLLC, Tony practiced for many years with trial boutique McKool Smith before leading the intellectual property section of Gruber Hurst Johansen Hail Shank. Tony’s legal practice encompasses all types of complex commercial and property disputes, in state and federal courts and in the Patent Trial & Appeal Board and the Trademark Trial & Appeals Board of the USPTO.
