19th Annual Ethics CLE Event Hosted by Klemchuk PLLC

DALLAS, Texas – Klemchuk PLLC, a leading litigation, intellectual property (IP), and business law firm, hosted its 19th Annual Ethics CLE Event on Friday, April 21, 2023, at Topgolf Dallas.

Attendees earned 90-minutes of Ethics CLE credit, and we thank the attorneys who served as our speakers. Many attendees stayed afterwards for golf and social hour at the reserved Topgolf bays. Complimentary food and beverages were provided during the event.

Chris Schwegmann and David Coale, of Lynn Pinker Hurst & Schwegmann

Schwegmann is a go-to trial lawyer in Texas for business disputes, with an emphasis on claims involving intellectual property. Coale is a top appellate lawyer in Texas, and is among the few lawyers to have handled a matter in all fourteen of the Texas intermediate courts of appeal.

Focused on the summary of the rules today in three important areas of professional responsibility:

  1. “Hot topic” – the law today about search-term advertising by lawyers. How exactly does it work? What ethics rules apply?

  2. Is this sanctionable? Review of recent cases, state and federal, about what is (and is not) potentially subject to sanctions, and jurisdictional limits on courts to order a sanction.

  3. Attorney immunity. Where do we stand today after a series of cases defining this doctrine in Texas?

Madson and Castello have each spent nearly 20 years practicing criminal law and offer a perspective that comes from working as both high-level prosecutors and defense attorneys.

Madson and Castello conducted an interactive discussion on “The Ethics of Punishment: Family Violence”, and ethical considerations in legislating and assessing penalties for family violence cases.

The presentation looked at the laws that govern family violence cases and affirmative findings of family violence as well as actual family violence scenarios, examined how Texas handles these cases, how the Texas Disciplinary Rules of Professional Conduct guide us, and if our system is getting it right.
