About Patent Registrability Searches

A patent search can be a fundamental step of the patent process. A patentability search will help identify prior granted patents, published patent applications, and other existing publications that could affect the registrability of a proposed invention. The patent search results will help identify bars to registration and potential obstacles within the process of patent examination.  Since the patent registration process is timely and expensive, the patent search conducted as a first step can be important to help identify third party rights that could impact the ability to obtain a registration, prior to spending efforts and money on an application.

Patent searches can range widely in cost, depending on who and how the search is conducted.  It is important that a skilled, professional patent searcher with an understanding of the specific invention technology perform the search, to get the best results.

At Klemchuk LLP, we help clients obtain patent clearance and/or registrability searches for clients.  We work with experienced professional searchers knowledgeable in various areas of technology to obtain search results that we interpret for clients to get a better understanding of the chances for obtaining registration. Searches can also help companies gauge risk before putting out a new product on the market by assisting in identifying prior rights in a particular technology.

With our flat fee patent search pricing option, we can help clients manage budgets and forecast expenses.

Why Obtain A Patent Search?

Patent searches provide foresight and give light to existing third-party prior rights. Before investing time and money in seeking patent protection, a patent search will help one determine whether to proceed with the patent process or go back to the drawing board, to potentially find a way around any discovered prior art. Patent search results could also help estimate the chances for success in obtaining registration of an invention as well as identify potential risk of infringing on prior existing rights.

Don’t Fall For DIY and Online Patent Search Companies

Often, the intent to save money is of importance for inventors and companies alike.  However, there is a danger of wasting money with some online patent search companies as well as with the free “do it yourself” patent searches. If the patent searcher isn’t knowledgeable in the relevant technology of the invention and qualified to perform a professional search, it is possible the results will not include all relevant information necessary to make an properly informed decision on whether to proceed with seeking patent registration or unveiling a new product in the marketplace.

Our patent attorneys offer patent searches for a flat rate price to provide no-surprise patentability advice for clients to make informed decisions on their inventions.
