Kirby Drake, Senior Associate at Klemchuk Kubasta LLP, recently presented at the State Bar of Texas Advanced Patent Litigation Course in San Antonio, TX.

The Advanced Patent Litigation Course offered a chance for participants to benefit from Drake’s knowledge and expertise concerning ethical issues that may arise in conducting discovery in patent litigation matters. Issues discussed included electronic discovery as well as document retention, preservation and production concerns. Drake discussed various recent decisions that have arisen related to ethical issues in the discovery context including the recent Rambus decisions out of the Federal Circuit, Qualcomm v. Broadcom, and the Personal Radio case out of the Eastern District of Texas. Drake also addressed numerous lessons that may be learned from these decisions. She touched upon lessons applicable to everyone that may be involved in discovery matters as well as lessons that may be particularly relevant to in-house as well as outside counsel.
