Copyright Enforcement and Copyright Infringement Defense

A copyright infringement lawsuit is typically the way copyrights are enforced by their owner. A rights owner may be the original author or an assignee of the copyrights. A plaintiff typically files a copyright application and obtains registration before filing a copyright litigation lawsuit. Obtaining a Copyright

From the inception of an idea, steps are necessary to ensure the appropriate exclusive rights in a work. A copyright provides the rights holder/owner with several exclusive rights. For example, the owner has the right to reproduce the work, prepare derivative works, and perform the work publicly. One of the best ways to protect the creative expression of those ideas is through registering the work with the U.S. Copyright Office.

What Is Copyright Protection?

A copyright provides protection for original works created by the author. However, the work made for hire doctrine in certain circumstances can shift ownership from employees to the employer company. Also, subject to certain legal exceptions, copyrights protect the exclusive right to copy and distribute a creative work for a period of time. Although copyright protection automatically exists in common law, the registration of a copyright is required to enforce your exclusive rights through copyright litigation.
